TERMS AND CONDITIONS OF SERVICE
AGREEMENT
1.1 Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the oBiz Platform operated by ODOC (PRIVATE) LIMITED (“ODOC”, “us”, “we”, or “our”).
1.2 By accessing or using our oBiz platform, and agreeing to our terms, you acknowledge that you understand and agree to be bound by these Terms and all terms incorporated by reference, and to be in compliance with all applicable laws and regulations. These Terms apply to all users of the platform (“User/s”).
1.3 If you do not agree to all of these Terms, do not access or use our platform or avail any services.
1.4 We reserve the right to change or revise these Terms at any time and in our sole discretion.
SERVICES
2.1 Our platform is designed to facilitate the provision of accountancy and tax filing services offered by third-party service providers. ODOC does not offer these services directly.
2.2 The services include but are not limited to bookkeeping, financial statement preparation, tax return preparation, tax payment facilitation, and tax advisory services. The entire process associated with accountancy and tax filing services are subject to the service standards agreed between ODOC and the Service Provider.
2.3 The services are provisioned by 3-LinK Consultants (Pvt) Ltd (the “Service Provider”, “Third Party Service Provider”).
FEES
3.1 The Service Fees for using our platform will be displayed at the point of service selection.
USER OBLIGATIONS
4.1 The Users must provide factual, accurate, true, and complete information as and when requested.
4.2 The User is responsible for keeping their account credentials secure.
4.3 The User must use the platform and its services strictly in compliance with all applicable laws.
DATA PROTECTION AND CONFIDENTIALITY
5.1 All personal information, sensitive personal data, and financial data obtained or provided on this platform must be dealt with in line with the Personal Data Protection Act No. 9 of 2022 and any applicable law.
5.2 The User shall be responsible for any Confidential Information disclosed by him/her on the platform.
INTELLECTUAL PROPERTY
6.1 The platform including its original content, features, and functionality are and will remain the exclusive property of ODOC and its licensors.
6.2 ODOC grants the User a non-exclusive, non-transferable, revocable license to access and use the oBiz Platform.
6.3 The User shall not reproduce, modify, publicly display the content of ODOC, attempt to extract the source code, or create derivative works from our platform.
LIMITATION OF LIABILITY AND INDEMNITY
7.1 ODOC shall not be responsible for any indirect, incidental, special or consequential damages, or any loss profits, even if informed of the possibility of such damages.
7.2 The User agrees to indemnify and hold harmless ODOC, its directors, officers, employees, agents and third parties, from any claims, liability, damages and/or costs arising from your use of the platform.
APPLICABLE LAW AND DISPUTE RESOLUTION
8.1 These terms and conditions shall be governed by and interpreted in accordance with the laws of Sri Lanka.
8.2 Any dispute arising out of or in connection with these terms and conditions, including any question regarding their existence, validity or termination, shall be referred to the Courts of Sri Lanka.
